1. Applicability

  1. These General Terms and Conditions apply to all offers, orders, agreements and deliveries via the Dos Padel webshop.

  2. By placing an order, the customer accepts these conditions.

  3. Deviations are only valid if they have been confirmed in writing or by e-mail by Dos Padel.

  4. If any provision is declared invalid, the remaining provisions will remain in full force and effect.

2. Offer and information

  1. Dos Padel's range includes padel rackets, clothing and accessories such as grips, overgrips, balls, bags and other sports items.

  2. Images, specifications and colors on the website serve as an indication and may differ, including due to screen settings or model changes.

  3. Obvious errors or mistakes (such as price errors or typographical errors) do not bind Dos Padel.

3. Conclusion of the agreement

  1. The agreement is concluded when Dos Padel confirms the customer's order by e-mail.

  2. Dos Padel reserves the right to refuse an order or request additional information, for example if there is suspicion of abuse, incorrect data or previous payment problems.

4. Prices and payment

  1. All prices are in euros and include VAT, unless expressly stated otherwise.

  2. Shipping costs are shown separately during checkout.

  3. Payment is made via the payment methods offered in the Shopify checkout (such as iDEAL, PayPal, Klarna, credit card, Apple Pay).

  4. Orders will only be processed and shipped after payment has been received in full.

5. Delivery and shipping

  1. Dos Padel ships orders within the Netherlands and internationally to the countries available during checkout.

  2. Mentioned delivery times are indicative and are not strict deadlines. To the extent permitted by law, delays do not give any right to compensation or termination of the agreement.

  3. Dos Padel is not liable for delays caused by carriers, customs, strikes, extreme weather conditions, technical failures or other circumstances beyond its control.

  4. The customer is at all times responsible for completing address details correctly and completely. Additional costs resulting from incorrect or incomplete address details (such as return or reshipment costs) will be borne by the customer.

  5. If a package is not collected, is refused or proves to be undeliverable, shipping and any return costs incurred will be charged to the customer.

  6. For international shipments, the customer is responsible for any import duties, taxes, customs fees and local restrictions. Refusal by customs or non-payment of import duties does not entitle you to a refund of shipping costs.

  7. When delivered to neighbors, a chosen delivery point or parcel locker, the package is considered delivered.

  8. Damaged shipments must be returned within 48 hours must be reported to Dos Padel upon receipt, accompanied by clear photos of the packaging and the product. After this period, no further investigation can be initiated with the carrier.

6. Right of withdrawal (return)

  1. Consumers have the right to enter 14 days to revoke the agreement after receipt of the order without giving any reason.

  2. During this reflection period, the customer may only handle and inspect the product as he would in a physical store. Use that goes beyond what is necessary to determine the nature, characteristics and operation of the product may lead to a reduction in value.

  3. The costs for return shipment are borne by the customer, unless expressly stated otherwise.

  4. Dos Padel will refund the purchase price (including any standard shipping costs for the outward shipment) within 14 days after receipt of the return shipment, provided the product has been received in good condition.

  5. Products must, if reasonably possible, be returned in their original condition and (if present) in their original packaging.

7. Exceptions to the right of withdrawal

Returns are not possible for, among others:

  • used or played padel rackets;

  • accessories such as grips, overgrips, dampeners and socks of which the (hygienic) packaging has been opened;

  • padel balls of which the packaging has been opened;

  • clothing that has been worn, washed, damaged, without labels or with obvious odors (perfume, smoke, deodorant, perspiration);

  • custom-made, personalized or special-order products;

  • products that, by their nature, deteriorate or wear out quickly.

8. Warranty

A. General

  1. Dos Padel applies the legal guarantee. This means that a product must do what the customer can reasonably expect from it.

  2. Warranty only applies to demonstrable damage factory defects and not for damage or wear caused by use.

B. Padel rackets

  1. Padel rackets are sports equipment that are subject to intensive use and impact. Warranty applies not for:

    • breaks, cracks or damage due to impact (such as contact with glass, fencing, floor, other rackets or objects);

    • damage due to misuse, abuse or overload;

    • cosmetic damage, scratches, dents or paint wear;

    • damage caused by extreme temperatures (for example left in a hot car);

    • damage to bumper strip, grip or wrist strap;

    • deformation due to improper maintenance or storage.

  2. Because Dos Padel cannot control the conditions of use, falls all breakages that occur during or after use in practice are excluded from the warrantyunless there is demonstrable manufacturing defect.

  3. For a warranty claim on a racket, Dos Padel can request photos, videos, proof of purchase and additional information. If necessary, the racket can be sent for assessment.

C. Clothing

  1. Warranty on clothing does not apply to:

    • normal wear and tear,

    • damage due to washing or drying contrary to washing instructions,

    • discoloration due to washing or sunlight,

    • damage due to incorrect use (e.g. cracks, abrasion).

D. Accessories

  1. Accessories such as grips, overgrips, balls, dampeners and bags are wear products. The warranty only applies to obvious manufacturing defects upon receipt.

  2. Wear and tear due to normal use (such as worn grips, softening balls, worn zippers due to frequent use) is not covered by the warranty.

9. Liability

  1. The use of sports equipment, including padel rackets, always takes place on own risk of the customer.

  2. Dos Padel is not liable for (sports) injuries, accidents or damage caused by the use of the products, nor for incorrect or unsafe use.

  3. Dos Padel is not liable for indirect damage, such as consequential damage, lost profits, missed savings or damage due to business or sports interruption.

  4. Dos Padel's liability is in all cases limited to the amount of the order in question, unless there is intent or gross negligence.

10. Complaints procedure

  1. Complaints about products or services can be submitted via info@dospadel.com.

  2. Dos Padel strives to respond to a complaint within 5 working days.

  3. If a complaint cannot be resolved by mutual agreement, the customer can turn to a dispute resolution body or the competent court in the Netherlands.

11. Force majeure

  1. Dos Padel is not obliged to fulfill any obligation if this cannot reasonably be expected of it as a result of force majeure.

  2. Force majeure includes: logistical disruptions, pandemics, war, riots, government measures, extreme weather conditions, disruptions at Shopify, payment providers or carriers, strikes, power outages, fire, natural disasters and other situations beyond the influence of Dos Padel.

  3. In the event of force majeure, Dos Padel's obligations will be suspended for the duration of the force majeure situation.

12.Privacy

Dos Padel processes personal data in accordance with the General Data Protection Regulation (GDPR). How and which data is processed is described in the Privacy Policy on the Dos Padel website.

13. Intellectual Property

All texts, images, logos, designs and other content on the Dos Padel website are the property of Mossmedia B.V. and/or Dos Padel and may not be reproduced, copied or made public without prior written permission.

14. Governing Law

These General Terms and Conditions and all agreements between the customer and Dos Padel are exclusive Dutch law applicable. Disputes will be submitted to the competent court in the Netherlands.

15. Changes

Dos Padel reserves the right to change these General Terms and Conditions. The most recent version can always be consulted via the website.
