1. Applicability
These General Terms and Conditions apply to all offers, orders, agreements and deliveries made through the Dos Padel webshop.
By placing an order, the customer accepts these terms and conditions.
Deviations are only valid if confirmed in writing or by e-mail by Dos Padel.
If any provision is declared invalid, the remaining provisions shall remain in full force.
2. Offer and information
The Dos Padel range includes padel rackets, clothing and accessories such as grips, overgrips, balls, bags and other sports items.
Images, specifications and colours on the website are indicative and may differ, for example due to screen settings or model changes.
Obvious errors or mistakes (such as pricing or typing errors) are not binding on Dos Padel.
3. Formation of the contract
The contract is concluded when Dos Padel confirms the customer's order by e-mail.
Dos Padel reserves the right to refuse an order or request additional information, for example in case of suspected misuse, incorrect details or previous payment problems.
4. Prices and payment
All prices are in euros and include VAT, unless expressly stated otherwise.
Shipping costs are displayed separately at checkout.
Payment is made using the payment methods offered in the Shopify checkout (such as iDEAL, PayPal, Klarna, credit card, Apple Pay).
Orders are only processed and shipped once payment has been received in full.
5. Delivery and shipping
Dos Padel ships orders within the Netherlands and internationally to the countries available at checkout.
Stated delivery times are indicative and are not strict deadlines. To the extent permitted by law, delays do not entitle the customer to compensation or termination of the contract.
Dos Padel is not liable for delays caused by carriers, customs, strikes, extreme weather conditions, technical failures or other circumstances beyond its control.
The customer is at all times responsible for entering address details correctly and completely. Additional costs resulting from incorrect or incomplete address details (such as return or reshipping costs) are borne by the customer.
If a package is not collected, is refused or proves undeliverable, the shipping and any return costs incurred will be charged to the customer.
For international shipments, the customer is responsible for any import duties, taxes, customs charges and local restrictions. Refusal by customs or non-payment of import duties does not entitle the customer to a refund of shipping costs.
When delivered to neighbours, a chosen pick-up point or parcel locker, the package is considered delivered.
Damaged shipments must be reported to Dos Padel within 48 hours of receipt, accompanied by clear photos of the packaging and the product. After this period, no investigation can be initiated with the carrier.
6. Right of withdrawal (returns)
Consumers have the right to withdraw from the contract without giving any reason within 14 days of receiving the order.
During this cooling-off period, the customer may only handle and inspect the product as they would be allowed to do in a physical store. Use that goes beyond what is necessary to establish the nature, characteristics and functioning of the product may lead to a reduction in value.
The costs of the return shipment are borne by the customer, unless expressly stated otherwise.
Dos Padel will refund the purchase amount (including any standard shipping costs of the original shipment) within 14 days of receiving the return, provided the product has been received in good condition.
Products must, where reasonably possible, be returned in their original condition and (if applicable) in their original packaging.
7. Exceptions to the right of withdrawal
Returns are not possible for, among others:
used or played-with padel rackets;
accessories such as grips, overgrips, dampeners and socks whose (hygienic) packaging has been opened;
padel balls whose packaging has been opened;
clothing that has been worn, washed, damaged, is missing labels or has noticeable odours (perfume, smoke, deodorant, perspiration);
custom-made, personalised or specially ordered products;
products that by their nature deteriorate or wear out quickly.
8. Warranty
A. General
Dos Padel applies the statutory warranty. This means that a product must do what the customer can reasonably expect of it.
The warranty applies exclusively to demonstrable manufacturing defects and not to damage or wear caused by use.
B. Padel rackets
Padel rackets are sports items subject to intensive use and impact. The warranty does not cover:
breaks, cracks or damage caused by impact (such as contact with glass, fencing, the floor, other rackets or objects);
damage caused by incorrect use, misuse or overloading;
cosmetic damage, scratches, dents or paint wear;
damage caused by extreme temperatures (for example, left in a hot car);
damage to the bumper strip, grip or wrist cord;
deformation due to incorrect maintenance or storage.
Because Dos Padel cannot control the conditions of use, all breaks occurring during or after use are in practice excluded from the warranty by default, unless a manufacturing defect can be demonstrated.
For a warranty claim on a racket, Dos Padel may request photos, videos, proof of purchase and additional information. If necessary, the racket may be sent in for assessment.
C. Clothing
The warranty on clothing does not cover:
normal wear and tear,
damage caused by washing or drying contrary to the care instructions,
discolouration due to washing or sunlight,
damage caused by incorrect use (e.g. tears, abrasion).
D. Accessories
Accessories such as grips, overgrips, balls, dampeners and bags are wear items. The warranty applies exclusively to clear manufacturing defects upon receipt.
Wear due to normal use (such as worn grips, balls becoming softer, zips worn out through frequent use) is not covered by the warranty.
9. Liability
The use of sports items, including padel rackets, is always at the customer's own risk.
Dos Padel is not liable for (sports) injuries, accidents or damage arising from the use of the products, nor for incorrect or unsafe use.
Dos Padel is not liable for indirect damage, such as consequential damage, loss of profit, missed savings or damage due to business or sports interruption.
Dos Padel's liability is in all cases limited to the amount of the order in question, except in cases of intent or gross negligence.
10. Complaints procedure
Complaints about products or services can be submitted via info@dospadel.com.
Dos Padel aims to respond to a complaint within 5 working days.
If a complaint cannot be resolved by mutual agreement, the customer may turn to a dispute resolution body or the competent court in the Netherlands.
11. Force majeure
Dos Padel is not obliged to fulfil any obligation if it cannot reasonably be expected to do so as a result of force majeure.
Force majeure includes, among other things: logistical disruptions, pandemics, war, riots, government measures, extreme weather conditions, failures at Shopify, payment providers or carriers, strikes, power outages, fire, natural disasters and other situations beyond Dos Padel's control.
In the event of force majeure, Dos Padel's obligations are suspended for the duration of the force majeure situation.
12. Privacy
Dos Padel processes personal data in accordance with the General Data Protection Regulation (GDPR). How and which data are processed is described in the Privacy Policy on the Dos Padel website.
13. Intellectual property
All texts, images, logos, designs and other content on the Dos Padel website are the property of Mossmedia B.V. and/or Dos Padel and may not be reproduced, copied or published without prior written permission.
14. Applicable law
These General Terms and Conditions and all agreements between the customer and Dos Padel are governed exclusively by Dutch law. Disputes will be submitted to the competent court in the Netherlands.
15. Changes
Dos Padel reserves the right to amend these General Terms and Conditions. The most recent version can always be consulted on the website.
